SMS Terms and Conditions

These SMS Terms and Conditions govern text messages sent by SmartChart Health, doing business as SomaX. By opting in to receive SMS messages from SomaX, you agree to these terms.

1. SMS Program Description

SomaX may send SMS messages related to your account and use of SomaX services. Messages may include:

  • Account registration and activation notifications
  • Account status and access updates
  • Login assistance and password reset notifications
  • Onboarding and account setup updates
  • Subscription or account change confirmations
  • Customer support follow-ups
  • Training or appointment reminders
  • Billing and payment notifications
  • Service updates and maintenance notices
  • Other important account-related communications

SomaX does not intend to include confidential patient information or protected health information in SMS messages.

2. Consent to Receive Messages

By providing your mobile phone number and opting in through a website form, account registration, written agreement, verbal consent, or another approved method, you authorize SmartChart Health and SomaX to send SMS messages to the number provided.

Consent to receive SMS messages is not a condition of purchasing or using SomaX services.

You represent that you are the owner or authorized user of the mobile number provided and that you are authorized to consent to receive messages at that number.

3. Message Frequency

Messaging frequency may vary depending on account activity, support requests, scheduled appointments, service updates, and other operational needs.

4. Message and Data Rates

Message and data rates may apply. Charges are determined by your mobile carrier and mobile service plan. SomaX is not responsible for fees charged by your carrier.

5. Opting Out

You may opt out of receiving SMS messages at any time by replying STOP to any message.

After submitting a STOP request, you may receive one final message confirming that you have been unsubscribed. You will not receive additional SMS messages unless you opt in again.

Other supported opt-out keywords may include CANCEL, END, QUIT, UNSUBSCRIBE, or STOPALL.

7. Supported Carriers

SMS delivery is subject to the availability and coverage of participating mobile carriers. Mobile carriers are not responsible for delayed or undelivered messages.

SomaX does not guarantee that every SMS message will be delivered successfully or within a specific timeframe.

8. Mobile Number Changes

You are responsible for notifying SomaX if your mobile number changes or is reassigned. You may update your contact information through your SomaX account or by contacting SomaX Support.

9. Privacy

SMS consent, mobile phone numbers, and opt-in information will not be sold or shared with third parties or affiliates for their own marketing or promotional purposes.

Information may be shared with service providers that assist SomaX in delivering SMS messages, subject to appropriate contractual, privacy, and security requirements.

10. Security and Sensitive Information

SMS messages may not be encrypted and may be accessible to anyone with access to your mobile device or mobile account.

Do not send passwords, payment card information, Social Security numbers, medical records, protected health information, or other sensitive information through SMS.

If you receive a message requesting sensitive information that appears to come from SomaX, contact SomaX Support before responding.

11. Changes to These Terms

SomaX may update these SMS Terms and Conditions from time to time. Updates will be posted on the SomaX website with a revised effective date.

Continued participation in the SMS program after updated terms are posted constitutes acceptance of the revised terms.
